This Privacy Policy applies to information we collect when you use our website located at www.lincode.ai (the “Website”) or any of our other websites, products, or services that provide a link to this Privacy Policy (collectively, our “Services”), as well as email, text, and other electronic messages between you and our Services. It also describes your choices regarding the use, access, and correction of your personal information. Additional terms and conditions may also apply to your relationship with Lincode, depending on how you choose to interact with us.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Policy, and in some cases, we may provide you with more prominent notice (such as adding a statement to our homepage or sending you an email notification). Information We Collect

We collect personal information when you access or use our Services. As used in this Privacy Policy, “personal information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate a specific individual, such as a name, address, email address, or phone number. We do not consider personal information to include information that has been aggregated and/or de-identified so that it does not allow a third party to easily identify a specific individual.

We collect personal information that is provided by you, collected automatically, and received from third parties, each as described below.

A. Information You Provide

We collect information, including personal information, when you access or use our Services or when you communicate with us. The amount and type of personal information that we collect depend on the nature of your interactions with us. Categories and examples of information you may provide include the following:

  • Account Information. We collect your name and email address in order to create your account on our Services. We may also collect information like username, password, company, department, job title, profile photo, phone number, or third-party login information.
  • Your Communications with Us. We may collect information such as your name, email address, phone number, job title, company name, and other information you choose to provide when you request information about our Services, complete forms, register for our newsletter or other publications, post comments on public or social media pages, request customer or technical support, or otherwise communicate with us.
  • Surveys. We may contact you to request feedback on our Services or participate in surveys. If you decide to participate, you may be asked to provide certain information, which may include personal information.
  • Payment Information. We collect payment information such as name, credit card number, billing address, and other payment information you may provide in connection with any purchases of Services.
  • Events. We may collect personal information if you register for or attend a conference, trade show, or other event, such as your name, company name, email, phone number, and marketing preferences.
  • Job Applications. We may post job openings and opportunities on the Website. If you reply to one of these postings by submitting your application, we will collect your name, email address, phone number, job history, resume, cover letter, and other information you choose to provide.

You may also provide information to be published or displayed (“posted”) on public areas of our Services or transmitted to other users of our Services or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we may enable you to set certain privacy settings for such information in your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of our Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

B. Information Collected Automatically

We (or our service providers) may automatically collect certain information relating to your use of our Services.

  • Your Use of Our Services. We may track certain information about you when you visit and interact with any of our Services. This information includes the pages you visit, the date and time of your visit, content you interact with, features you use, links you click on, the frequency and duration of your activities, and other data and metadata about how you interact with our Services.
  • Device and Connection Information. We collect information about your computer, phone, tablet, or other devices you use to access our Services. This device information includes your connection type and settings when you install, access, update, or use our Services. We also collect information through your device about your operating system, browser type, internet protocol (IP) address, media access control (MAC) address, Internet service provider (ISP), language settings, location of your device or computer, version and time zone settings, URLs of referring/exit pages, device identifiers, crash data, and certain other information about features of your mobile device for which we will ask your permission.
  • Cookies and Other Tracking Technologies. We and our third-party partners use cookies and other tracking technologies to provide functionality and to recognize you across different Services and devices. C. Information We Receive from Third Parties

We may also obtain information about you from third-party sources, including your employer, public databases, social media platforms, marketing and business partners, and security and fraud detection firms. Information we may obtain from such third parties includes your name, contact information, location information, job history, and information about your company and sector. We may combine this information with information we collect through other means described above. This helps us to update and improve our records, maintain security, identify new customers, create more personalized advertising, and suggest services that may be of interest to you. Examples of third-party sources and the type of information we receive are as follows:

  • Your Employer. Your employer or other personnel at your employer may provide your contact information when designating you as a user, administrator, or other contact on your company’s account.
  • Other Services Linked to Your Account. We receive information about you when you or your administrator integrate third-party services into our Services. For example, if you create an account or log in to our Services through a third party, such as Google, that third party may provide us with your name, email address, user ID, an access token, or any information that you have permitted the third party to share with us or made public in connection with that service. The information we receive when you link or integrate our Services with a third-party service depends on the settings, permissions, and privacy policy controlled by that third-party service. You should always check the privacy settings and notices in these third-party services to understand what data may be disclosed to us or shared with our Services.
  • Our Partners. We work with a global network of partners who provide consulting, automation, fabrication, implementation, training, and other services related to our Services. Some of these partners also help us to market and promote our Services, generate leads for us, and resell our Services. We receive information from these partners, such as company and employee names, contact information, geographical information, billing information, what Services you have purchased or may be interested in, and evaluation information you have provided.
  • Third-Party Providers. We may receive information about you from third-party providers of business information and publicly available sources (like social media platforms), including physical mail addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), IP addresses, and social media profiles, for the purposes of targeted advertising of products that may interest you, delivering personalized communications, evaluating candidates for employment, event promotion, and profiling.
  • Employee Referral or Screening Services. If you apply for a job or engage a recruiter, we may obtain information about you from employee referral or screening services, such as background and screening checks, information from referees, and other information about your education and professional experience that you choose to make publicly available on the internet and social media services.

Use of the Information We Collect

How we use the information we collect depends in part on which Services you use, how you use them, and any preferences you have communicated to us. We use the information we collect for the following purposes:

  • Providing Our Services. We use information about you to (i) provide, administer, and facilitate your use of our Services, (ii) establish your profile and registration information, (iii) manage your account preferences, (iv) personalize your experience while using our Services, and (v) process and fulfill any orders for products or services.
  • Communication with You. We use information about you to (i) communicate with you about your account and account activity, (ii) respond to inquiries or solicit your feedback, (iii) send you emails and newsletters about us, our Services, or other websites and services that may be of interest to you, and (iv) send you administrative messages and information, including about changes to our Services and updates to our Terms and Privacy Policy.
  • Customer Support. We use information about you to (i) troubleshoot and resolve technical issues you encounter, (ii) respond to your requests for assistance, (iii) analyze crash information, and (iv) repair and improve our Services.
  • Safety and Security. We use information about you to (i) verify accounts and activity, (ii) detect, prevent, and respond to potential or actual security incidents, and (iii) monitor and protect against fraud and abuse.
  • Research and Development. We are always looking for ways to make our Services smarter, faster, secure, user friendly, integrated, and useful. We use information and collective learnings about how people use our Services to (i) understand and analyze the usage trends, behaviors, and preferences of our users, (ii) maintain, develop, support, and improve our Services, (iii) develop new products, features, and technologies that benefit our users and the public, and (iv) test and analyze certain new features with some users before rolling the feature out to all users.
  • Advertising. We use information about you to (i) market, promote, and drive engagement with our Services, (ii) communicate with you about new Services, product offers, promotions, and contests, and (iii) advertise our Services on third-party websites or mobile applications using aggregated statistical or anonymized data. We may also use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.
  • Government or Legal Matters. We may use information about you to (i) perform any actions as may be required by applicable law or regulations, (ii) respond to requests from public and government authorities, or (iii) protect our rights, privacy, safety, or property, or that of our affiliates, you, or others.
  • With Your Consent: We use information about you where you have given us consent to do so for a specific purpose not listed above. For example, with your permission, we may publish testimonials or featured customer stories to promote our Services.

Disclosure of the Information We Collect

We may share information we collect about you in the following ways:

  • Affiliates and Service Providers. We may share your information with our subsidiaries and affiliates, and our and their respective employees, contractors, service providers, and agents we use to support our business who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • Third-Party Service Providers. We may share your information with individuals and third-party companies that perform services on our behalf, including for payment processing, order fulfillment, data storage or analysis, marketing services, advertising services, email and hosting services, services that process and administer consumer surveys, and customer services and support. We may also share your information with third-party companies that we partner with to provide certain services to you in connection with our Services, such as deployment, integration, fabrication, automation, and support activities in connection with our Services. Those partners’ collection and use of information are subject to their privacy policies and other terms.
  • Analytics and Data Enrichment Services. We use third-party analytics to help understand your usage of our Services and to improve our Services (e.g., Google Analytics). We may provide your contact information, registration information, technical information, usage data, or de-identified data to data enrichment services, which may match such information with publicly available database information, including contact and social information from other sources, such as your email address, company, job title, website URLs, social network information, and physical addresses. We use this combined information to communicate with you in a more effective and customized manner.
  • Your Employer. We may (i) share your name, email address, and basic account activity information with your employer or other personnel at your employer who have administrative or similar privileges (an “Employer Admin”), and (ii) transfer control of your account to such Employer Admin. If your account is transferred, the Employer Admin will be able to access, transfer, and control your account, including all content and activity associated with it, as well as make changes to and delete the account.
  • Required by Law and Similar Disclosure. We may access, preserve, and disclose your personal information or other account information (i) if we believe doing so is required or appropriate to comply with applicable law, regulations, law enforcement requests, or legal processes, such as a court order or subpoena, or (ii) to protect our rights, privacy, safety, or property, or that of our affiliates, you, or others.
  • Corporate Transactions. If we become involved in a potential merger, acquisition, bankruptcy, change of control, sale of some or all of our assets, or financing, your personal information may be transferred or disclosed in connection with such a business transaction.
  • Aggregate or De-identified Information. We may share information in aggregated and/or anonymous form that cannot reasonably be used to identify any individual.
  • Consent. We may also disclose your personal information with your permission.

We and our authorized third parties may use cookies, web beacons, log files, and similar technologies as described in this Privacy Policy.

A. What Is a Cookie?

A cookie is a small file containing a string of information that is sent to your computer or mobile device when you visit a website or mobile application. Cookies are then sent back to the originating site on each subsequent visit, or to another site that recognizes those cookies. We may use session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience, as further described in this Privacy Policy.

B. What Are Related Technologies?

In addition to cookies, we may use other technologies that are similar to cookies or used for similar purposes, including the following:

  • Web Beacons. Web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) are tiny graphic images with a unique identifier, similar in function to cookies, that are used to track online movements of web users. Certain pages on our Website may contain web beacons. In contrast to cookies, which are stored on a user’s hard drive, web beacons are embedded invisibly in web pages.
  • Log Files. When you use our Services, our servers automatically record certain log file information from your browser or device. These server logs may include anonymous information such as your web request, browser type, referring/exit pages and URLs, number of clicks, how you interact with links on our Services, domain names, landing pages, pages viewed, and other information.
  • Software Development Kits. Software development kits (SDKs) are third-party software tools that may be installed in our applications. SDKs collect certain information about the device and network you use to access the application and help us understand how you interact with our Services.
  • Fingerprinting. Fingerprinting involves combining a set of features or characteristics from a device or browser (e.g., information from HTTP headers, browser language, time zone, JavaScript objects, installed fonts, installed plugins) in order to uniquely identify you. We may use fingerprinting for security or user safety purposes.

C. How Do We Use Cookies and Related Technologies?

We and our authorized third parties use cookies and related technologies to ensure the proper functioning of our Services, store your preferences, measure traffic and usage trends, optimize and improve our Services, and deliver advertisements that may be of interest to you.

We also use analytics tools to collect information about your use of our Services, and these tools typically make use of cookies and related technologies. Some of the third-party tools we use include:

  • Google Analytics. We use Google Analytics to enable us to better understand your use of our Services. Like many services, Google Analytics uses first-party cookies to track user interactions, which is used to compile usage reports. The reports disclose trends without identifying individual users.   • HubSpot. We use HubSpot’s web traffic analytics tool to understand how you interact with our Website, including measuring traffic, analyzing page performance, and comparing key metrics.   • Advertising Partners. We may partner with third-party advertising services and social media platforms to advertise on the Website and third-party websites (including Google and LinkedIn). Third-party vendors, like Google and LinkedIn, use cookies to serve ads based on someone’s past visits. You can set preferences for how Google and/or LinkedIn advertises to you using the Google Ad Preferences page or the LinkedIn Ads settings page. You can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.

D. Controlling Cookies

You can control or reset your cookies and similar technologies through your web browser, which allows you to customize your cookie preferences and refuse all cookies or to indicate when a cookie is being sent. Please note that some features and functionality of our Services may not work properly if cookies are disabled. Similarly, deleting cookies or related technologies will also delete preference settings associated with such cookies or tracking technologies, and the functionality of our Services will be impaired. If you want to change your cookie preferences at any time (for example, if you accept all cookies, but later decide you do not want a certain type of cookie) you’ll need to adjust your browser settings to remove any third-party cookies or related technologies. In addition to managing cookies in your browser settings (described above), you can opt out of certain cookies by visiting the websites of those individual third-party services (such as Google) and following their instructions.

E. Do Not Track Browser Setting

Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, we do not currently respond to “Do Not Track” signals.

Data Security and Retention

We seek to protect your personal information from unauthorized access, use, and disclosure using appropriate physical, technical, organizational, and administrative security measures based on the type of personal information provided and how we are processing that information. Please be aware, however, that no information system can be guaranteed to be 100% secure, so we cannot guarantee the absolute security of your information. Moreover, we are not responsible for the security of information you transmit to our Services over networks that we do not control, including the Internet and wireless networks. Except as expressly required by law, we are not responsible for the theft, destruction, loss, or inadvertent disclosure of your information or content.

Your information collected through our Services will be stored and processed in the United States and any other country in which we or our service providers maintain facilities or employ staff or contractors. We transfer information that we collect about you, including personal information, to affiliated entities, and to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. As a result, we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. However, we always take steps to ensure that your information remains protected wherever it is stored and processed in accordance with applicable laws. Where required under applicable laws, you consent to the transfer of information to the U.S. or any other country in which we or our service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

We store the personal information we collect for as long as is necessary for the purposes for which we originally collected it, such as for as long as you have an open account with us or as otherwise necessary to provide you with our Services. In some cases, we retain personal information for as long as necessary to comply with our legal obligations, resolve disputes or collect fees owed, or as otherwise permitted or required by applicable law, rule, or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify a specific individual.

Children’s Privacy

Our Services are not directed to individuals under the age of 16. We do not knowingly collect personal information from children under the age of 16. If we become aware that a child under the age of 16 has provided us with personal information, we will take steps to delete such information. Your Rights and Choices

A. Privacy Laws

You may have certain rights and choices with respect to your personal information. Please note that your rights will depend on where you are located and applicable privacy and data protection laws. These may include, for example, the right to access your personal information, request correction or deletion of your information, object or opt out to our processing of your information, request the restriction of the processing of your information, and/or request portability of your information. Depending on your location and applicable law, you may have the right to appeal the denial of any of these rights.

Please note that we may ask you to verify your request. If you are an authorized agent making a request on another’s behalf, we may also ask you to provide confirmation that you have the proper authority to make the request on that person’s behalf, or we may ask the person to verify their identity with us directly.

B. Opting Out

In addition to the rights described above, we strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Electronic Communications. We may, from time to time, send you electronic communications (e.g., email or text messages) regarding our products and services, or products and services we think you may enjoy. You can choose not to receive these emails by clicking the unsubscribe link in any email or responding appropriately to any text message. Please note that you may not be permitted to unsubscribe or opt out of non-promotional messages regarding your account, such as account verification, orders from us, changes or updates to features of our Services, or technical or security notices.
  • Cookies. As described above, you may also refrain from providing or may withdraw your consent for cookies via your browser settings. Your browser’s help function should contain instructions on how to set your computer to accept all cookies, to notify you when a cookie is issued, or to not receive cookies at any time. Please keep in mind that certain cookies are required to authenticate users and effectively use our Services.
  • Google Analytics. You may opt out of Google Analytics’ services using the Opt Out feature on their website. The Google Analytics service is provided by Google Inc. C. Access, Update, or Delete Your Personal Information

You may update certain account information in your account settings associated with our Services. You may also contact us at support@lincode.ai to update or delete your personal information. We may not be able to update or delete information in all instances, such as (i) where information is retained in technical support logs or other business records, or (ii) if we believe such change would violate any law or legal requirement or cause the information to be incorrect. We may retain information that has been de-identified or disassociated with personal identifiers such that it can no longer be used to reasonably identify a particular individual.

GDPR Disclosure

This section of the Privacy Policy applies to you if you reside in the European Union, the European Economic Area, the United Kingdom, or Switzerland (collectively, the “Designated Countries”). Lincode processes your personal data in accordance with European laws and regulations, such as the General Data Protection Regulation (“GDPR”) and similar laws and regulations.

A. Legal Basis

If you reside in one of the Designated Countries, we need a lawful basis to collect, use, and disclose your personal data. Our lawful basis will depend on the information concerned and the context in which it is processed, and may include the following:

  • Contractual Necessity: To provide our Services to you and fullfil our obligations to you under our Terms and any other applicable contract, including creating and maintaining your account, resolving issues you may experience with our Services, and obtaining payment for our Services.
  • Legitimate Interests: For our legitimate interests (which are not overridden by your data protection interests), including for research and development, marketing and promoting our Services, displaying advertising and tracking its effectiveness, making more informed predictions, decisions, and offers for our users, and protecting our legal rights and interests.
  • Legal obligations: Where we need to process your personal information to comply with a legal or regulatory obligation.
  • Consent: You consent to us, or our third-party partners, using your information for a specific purpose, and we use such information within the scope of such consent. If we do rely on your consent to use your personal information, you have the right to change your mind at any time (but this will not affect any processing that has already taken place).

Where we use your information for our legitimate interest, you have the right to object to that use by contacting support@lincode.ai. However, if you do, it may diminish the quality of our Services you receive or prevent you from using our Services.

B. Controller

Lincode is the “Controller” (for the purposes of the GDPR) of your personal information. Our address is listed below under “Contacting Us”.

C. Data Storage

We store information about users on servers primarily located in the United States, and we may also store such information on servers and equipment in other countries where our affiliates and service providers are located. If you are accessing our Services from outside of the United States, please know the data and personal information you submit may be transferred to and stored on servers in the United States or other countries.

D. Your Rights

Residents in the Designated Countries and other regions may have additional rights under their laws. Depending on your jurisdiction, these rights may include:

  • Right of access. The data subjects may have the right to obtain from the controller confirmation that their data are processed properly, and they shall have the right to access their personal data.
  • Right to rectification of information. The data subject may have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her.
  • Right to erasure (to be forgotten). The data subject may have the right to obtain from the controller the erasure of personal data concerning him or her.
  • Right to restriction of processing. The data subject may have the right to obtain from the controller a restriction of processing where one of the following applies:
    • the accuracy of the personal data is contested by the data subject for a period enabling the controller to verify the accuracy of the personal data;
    • the processing is unlawful, and the data subject opposes the erasure of the personal data and requests the restriction of its use instead;
    • the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise, or defense of legal claims.
  • Right to data portability. The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, and have the right to transmit that data to another controller without hindrance from the controller to which the personal data have been provided. Please have in mind that this right will not be enforceable to:
    • the third parties’ data that you have provided to the controller; and
    • the data that concern you but have been provided to the controller by third parties.
  • Right to object. The data subject shall have the right to object to the processing of personal data concerning him or her. You shall be able to object to the commercial communications submitted.

Our Services may link to and may be linked by websites operated by other entities or individuals. Some of these websites may be co-branded with our name or logo. Personal information collected on other sites and services is subject to the privacy policy and practices of the third party providing such a website or service and not this Privacy Policy. You should consult the respective privacy policies of those third-party websites.

Changes to this Privacy Policy

This Privacy Policy is subject to occasional revision, and if we make any material changes in the way we use your personal information, we will notify you by sending you an e-mail to the last e-mail address you provided to us (if any), and/or by prominently posting notice of the changes on our Services. You are responsible for providing us with your most current e-mail address. If the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. Any changes to this Privacy Policy will be effective upon the earlier of thirty (30) calendar days following our dispatch of an e-mail notice to you (if applicable) or thirty (30) calendar days following our posting of notice of the changes on our Services. These changes will be effective immediately for new users of our Services. Continued use of our Services following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
